Welcome to www.mafiajewellery.com.  This website is operated by Mafia Jewellery Incorporated and registered at 81 Somerset Street West, Suite 1, Ottawa, Ontario, K2P 0H3, Canada.  Please read these terms and conditions carefully, as they will apply to any purchase you make via mafiajewellery.com.

By placing an order directly on the website or with one of our sales advisors for any item, you will be agreeing to be bound by these terms and conditions.  If you do not wish to be bound by these terms, please do not place an order. Please note that the general terms of use also apply to your use of the website.

1. ACCESS TO MAFIAJEWELLERY.COM

As a reseller, our sale advisor will have provided you with a unique discount code to use when ordering your product.

You agree to keep your discount code confidential and not allow any other person to use your code. If you have friends or family who wish to purchase wholesale items displayed on mafiajewellery.com, please ask them to contact our sales advisor via 613-898-8674. If you believe someone has unauthorized access to your unique discount code, please notify us as soon as possible and we will assist you with a new code.

We accept no responsibility or liability for failure by you to keep such discount code secure. We recommend that you have up to date virus software installed.

2. PROTECTING YOUR PERSONAL INFORMATION

We appreciate that the protection of your privacy is of paramount importance to you. Accordingly, we will only use your information for strictly limited purposes. This means holding and using your information for the purpose of dealing with your inquiries and to authorize individual purchase transactions. We may pass your data to trusted third parties for these purposes. We collect personal information as part of the order process, such as your name, email address, phone numbers, home address, shipping and credit card billing addresses so that we can process and fulfill your order. We will not pass your info to any third parties for marketing purposes or use your data for marketing purposes ourselves unless you expressly consent to this.

We do collate statistical information about site traffic, sales and other commercial information, but these statistics do not include any info which will identify you personally.

Our site uses cookies, (a cookie is a piece of information that is stored on your computer’s hard drive by your web browser, which allows the website to remember your preferences). Most browsers are automatically set to accept cookies, but usually you can alter the settings of your browser to prevent automatic acceptance. 3. ITEMS AVAILBLE FOR SALE

Some of the items featured on the website mafiajewellery.com may not be available for sale. This may be because they are already sold out, or as a result of a timing delay in the production of the piece from the display sketch, or for other reasons.

The price of any item is available on the website. The price quoted is the current price of the item. It does not include any taxes, charges or duties (including import duty) that may be payable. Please see Section 6 for further information.  We reserve the right to update the price of items available for purchase at any time but we will not update any price once we have confirmed you order.

Whilst we use all reasonable endeavors to accurately state the price of an item, if there is any error or material inaccuracy regarding pricing and/or the description of an item, we reserve the right to withdraw the item from sale an reject any offer by you. We are under no obligation to provide any item to you at an incorrect or lower price if there is a price error. We will inform you of any price errors that may affect your purchase.

4. PAYMENT

Payment on www.mafiajewellery.com must be made through PayPal. 

6. COLLETION/DELIVERY

Your item will not be available for delivery until we have received the full purchase price in cleared funds. If your item is in production when ordered or is made to order, then our sales advisor will advise you of the likely collection or delivery times (as appropriate).

We will ship out your item when your item is available for delivery. We will notify you of the shipping number immediately.  

All costs of delivery will be met by you (the consumer) including insurance of the item during transit. You are responsible for any taxes, duties (including import duties) and charges that may arise and be due (see 6).

6. DUTIES, TAXES AND CHARGES

When you ask us to deliver an item overseas, there may be duties, taxes and/or charges levied in the country to which you request the delivery of the item. Please also note that if we deliver the product to you in one country and you transfer it to another, there may be additional duties, taxes and charges. All such duties, taxes and charges are your sole responsibility and must be borne by you.

In addition, any charges for import clearance will be borne by you and you acknowledge and agree that you will be the imported or record for the item.

You acknowledge and agree that we will have no liability to you in respect to this information or any related advice given. We recommend you conduct your own investigation in respect to the charges attached to the purchase and delivery of the item. Local custom offices should be able to assist you with this.

Please note that your item may also be subject to inspection by relevant customs authorities.

7. UNWANTED ITEMS

We expect you to be delighted with the item and quality of workmanship invested in each item.

However in the event you wish to exchange or return any unwanted items to Mafia Jewellery, you may do so provided you notify us in writing and return the item in a fully resalable, including unworn, condition (i.e. in exactly the same condition in which the item was collected or delivered to you within 21 days of receipt.)

The item packaging (including any boxes and transport materials constitutes part of the item and you will need to also return all such packaging in an undamaged condition. Any other items materials received, such as certificates of authenticity cards must also be returned.

You will be responsible for all costs associated with all costs associated with returning any unwanted item and the safety and security of the item until it is safely received by us.

We recommend that you obtain sufficient insurance for the item during transit.

There are certain items which fall outside of this return policy, including:

-          Items made to order

-          Personalized items

You will be notified during the purchase process if the item falls outside of our return policy.

8. DAMAGED/FAULTY ITEMS

We take great care in the creation of all our items, as well as when dealing with and delivery of your item to you. In the unlikely event of faults of the item, or damage to the item in delivery to you, please contact our sales advisor immediately. Our items are manufactured to the highest quality standards and we will always endeavor to address concerns over defects promptly and fairly.

We reserve the right to inspect such items within 7 days of your complaint.

We will discuss delivery options with you should this be required.

We offer a warranty on items within 6 months of delivery.

This means that if the item develops a fault and you notify us within 6 months of collection or delivery, that the fault is developed or becomes apparent, you will be entitled, at our election, to a refund, repair or replacement.

For jewellery, our warranty is restricted to a warrant that the item is free from substantial defects in manufacture. This means that we will refund, repair or replace any item where, (within 6 months of delivery to or collection by you of the item), it can be proved that at the time of delivery or collection, there was as substantial manufacturing defect in the item.

We are unable to guarantee that we will always refund, repair or replace free of charge, stones that fall out or become misaligned, unless it can be proved conclusively that this was the direct result of a substantial manufacturing defect.

You should always insure you have insurance to cover the loss of stones or other accidental damage to the item. We will treat your requests sympathetically, but we reserve the right to reject the repair at our discretion.

If your piece breaks, we will send you another free of charge.  We request that you send the broken item back to us, at cost to you.

None of this affects any statutory of other legal rights you may have.

9. REFUND OF PURCAHSE PRICE

In the event that we agree to refund you, we will reimburse you in respect of the full purchase price paid to Mafia Jewellery within 30 days of receipt of the item. The refund will be made in the currency in which the payment for the item was settled.  

10. COMPANY’S LIABILITY TO YOU

If we breach these terms of sale, or we are negligent, we will only be liable for your losses which are direct losses and are reasonably foreseeable consequence of our negligence.

We are not liable for indirect losses, e.g. loss of profit, loss of goodwill, etc. Furthermore, we will not be liable for any failure to meet our obligations, where failure is due to events beyond our control.

11. GOVENRING LAW AND JURISDICTION

These term and conditions and any contract between us relating to the purchase of items via this website will be made to you under the substantive laws of Canada in the province of Ontario, to the exclusion of the United Nations Convention in the International Sales of Goods of 11 April 1980, and you agree to the exclusive jurisdiction of the courts of Ontario, Canada in respect to any dispute or claim arising out of or in relation to such contracts and/or these terms.
